FOR IMMEDIATE RELEASE - Alcoholic Beverage Control Enforcement

ALAMEDA COUNTY, CA – On Monday, October 8, 2021, the Alameda County Sheriff’s Office Crime Prevention Unit (CPU) conducted a general enforcement operation in unincorporated Alameda County targeting Alcoholic Beverage Control (ABC) licensed establishments.
Patrol units are often inundated with calls for service regarding subjects loitering in front of these businesses, consuming alcohol, littering, panhandling, and using illicit drugs. The mission of the operation was to enforce ABC and other local laws and county ordinances in unincorporated Alameda County.
During the operation, eight subjects were issued warnings and educated regarding ABC laws, specifically regarding BPC 25620(a) - Open container of alcohol in a public place. Deputies exercised their discretion and evaluated the totality of the circumstances when deciding whether to issue a citation. In majority of the contacts, providing education was determined to be the most appropriate action.
One subject was arrested for PC 647(f) after demonstrating he was intoxicated and unable to care for himself. The subject was loitering in front of Model Liquors II and stumbling dangerously close to the heavy vehicular traffic near the intersection of Lewelling Boulevard and Meekland Avenue. A preliminary alcohol screening resulted in an estimated Blood Alcohol Content (BAC) of .232.
The CPU contacted the business owners at all locations where subjects were found
loitering on the property. Merchants were educated and offered help to address ongoing issues surrounding their business. None of the business owners appeared to condone subjects loitering on their property.
The Sheriff’s Office will plan future operations for continued monitoring and enforcement of alcoholic beverage sales and regulatory laws.
